Is it a crime to take and give interest?
Scholars differ in understanding some of the rules of Islam, one of which is the issue of usury, in which the opinion of the scholars is different. Both are cursed while the other group is saying that not only the lender on interest (usurer) is the culprit. He was not found guilty. Obviously, the scholars on both sides have tried to understand the matter to the best of their ability.
Disagreement in knowledge is not a bad thing but it opens new doors of knowledge. Knowledge moves forward, otherwise, knowledge suffers from stagnation. Therefore, there is no harm in disagreement. It happens and the progress of knowledge stops. Well, we come to our subject. Simplicity in speech and words is our mission. As we said in the beginning, one group of scholars considers both the usurer and the usurer as guilty and the other group only considers the usurer.
The first group ended up saying that the Prophet (peace and blessings of Allah be upon him) cursed them both in the hadeeth, so they ended up talking. Take First we turn to the Book of Allah then we will look at the hadiths one by one. First, we look at usury then what is called usury۔
The demand for interest on a loan is called interest.
There are two types of objects.
1. Things that can survive when used. USEABLE
2- items that cannot survive on use. CONSUMABLE
There is interest in other types of goods. Islam forbids asking for more.
To understand the matter, they give a pseudonym to the usurer and the receiver so as not to create confusion.
1- The usurer (usurer) (b)
2- Debtor (C)
With this name we used, B and C to understand the point
Let us first look at the verses in turn.
In Surah Al-Baqarah, Allah Almighty has discussed this in great detail.
Those who consume interest will stand ˹on Judgment Day˺ like those driven to madness by Satan’s touch. That is because they say, “Trade is no different than interest.” But Allah has permitted trading and forbidden interest. Whoever refrains—after having received a warning from their Lord—may keep their previous gains, and their case is left to Allah. As for those who persist, it is they who will be the residents of the Fire. They will be there forever.
— Dr. Mustafa Khattab, the Clear Quran
Those who consume interest1 cannot stand [on the Day of Resurrection] except as one stand who is being beaten by Satan into insanity. That is because they say, "Trade is [just] like interest." But Allah has permitted trade and has forbidden interest. So whoever has received an admonition from his Lord and desists may have what is past, and his affair rests with Allah. But whoever returns [to dealing in interest or usury] - those are the companions of the Fire; they will abide eternally therein.
— Sahih International
O, believers! Fear Allah, and give up outstanding interest if you are ˹true˺ believers.
— Dr. Mustafa Khattab, the Clear Quran
O you who have believed, fear Allah and give up what remains [due to you] of interest if you should be believers.
— Sahih International
In this verse also Allah Almighty is saying that give up what is left of usury. Who will give up? B
If you do not, then beware of war with Allah and His Messenger! But if you repent, you may retain your principal—neither inflicting nor suffering harm.
— Dr. Mustafa Khattab, the Clear Quran
And if you do not, then be informed of a war [against you] from Allah and His Messenger. But if you repent, you may have your principal - [thus] you do no wrong, nor are you wronged.
— Sahih International
If it is difficult for someone to repay a debt, postpone it until a time of ease. And if you waive it as an act of charity, it will be better for you, if only you knew.
— Dr. Mustafa Khattab, the Clear Quran
And if someone is in hardship, then [let there be] postponement until [a time of] ease. But if you give [from your right as] charity, then it is better for you, if you only knew.
— Sahih International
O believers interest! Do not consume interest, multiplying it many times over. And be mindful of Allah, so you may prosper.
— Dr. Mustafa Khattab, the Clear Quran
O you who have believed, do not consume usury, doubled and multiplied, but fear Allah that you may be successful.
— Sahih International
In this verse also the one who eats usury ie B is commanded.

taking interest despite its prohibition, and consuming people’s wealth unjustly. We have prepared for the disbelievers among them a painful punishment.
— Dr. Mustafa Khattab, the Clear Quran
And [for] their taking of usury while they had been forbidden from it, and their consuming of the people's wealth unjustly. And We have prepared for the disbelievers among them a painful punishment.
— Sahih International
In this Surah too, Allah Almighty is warning by addressing B.
Whatever loans you give, ˹only˺ seeking interest at the expense of people’s wealth1 will not increase with Allah. But whatever charity you give, ˹only˺ seeking the pleasure of Allah—it is they whose reward will be multiplied.
— Dr. Mustafa Khattab, the Clear Quran
And whatever you give for interest [i.e., advantage] to increase within the wealth of people1 will not increase with Allah. But what you give in zakāh,2 desiring the face [i.e., approval] of Allah - those are the multipliers.3
— Sahih International. this Surah too, Allah Almighty has addressed B
In this Surah too, Allah Almighty has addressed B.
And it is rebuked that such wealth does not increase in the sight of Allah Almighty nor will it benefit him.
These are almost verses in the Qur'an which are related to usury. You can see that something else has happened. The victim has said that he has been instructed to give up what is left in usury for him. On the other hand, for B, there is talk of all kinds of punishment. And he said to them: Do not be unjust, do not be unjust. The more interest you will receive, the more hell will befall you. Allah and His Messenger also threatened to declare war.
In this whole discussion, we saw very harsh words for B, but for C, he asked for all kinds of concessions, and soft corners and concessions. We looked at the verses of the Qur'an. Man is endowed with intellect and consciousness. The Qur'an is a word to be read carefully. If you also meditate, you too will understand.
The result of the whole discussion is that in every way B is becoming the culprit i.e. the one who is the usurer and C the one who is the borrower. Concession for this, soft corner, and oppressed.
Now we come to the hadeeths of Mubarak. We first collect them all and review them. These hadeeths have appeared in both Sahih Bukhari and Sahih Muslim. And let us see what the Prophet of Mercy says.

Musa ibn Ismail narrated from us, Jarir ibn Hazem narrated from us, Abu Java Imran ibn Tamim narrated from us, and Samra ibn Jun dab narrated from him that After reading (usually) they would sit facing us and ask if anyone had a dream tonight. The narrator said that if anyone had a dream, he would narrate it and the Prophet (peace and blessings of Allah be upon him) would narrate its interpretation to Allah. One day the Prophet (peace and blessings of Allah be upon him) asked us as usual, "Have any of you had a dream tonight?" We pleaded that no one saw. Peace be upon him. He said, "But I had a dream tonight that two men came to me." They took my hand and led me to the Holy Land. (And from there the upper world guided me) What I see a man is sitting, and a man standing and in his hand (Imam Bukhari (may Allah have mercy on him) said) some of our companions (probably Abbas bin ) This is what Fadhil Isqati narrated from Musa ibn Ismail. There was an iron ankle which he would put in the jaw of the person sitting and tear to the back of his head and then he would do the same with the other jaw. During this time, his first jaw would return to normal, and then he would cut it again as before. I asked what was going on? The two men with me said go ahead. So we went ahead and came to a man who was lying on his head and another man was standing on his head for a big stone. He used this stone to crush the head of a layperson old man was sitting, in. When he hit her on the head with a stone, the stone would go away and he would pick her up. He would not even come back with a stone so that his head would be straight again. Just like before. When he returned, he struck her again. I asked who are these people? They both replied that they should go further. So as we proceeded, we headed for an oven-like pit. The upper part of which Tight but wide from the bottom. The fire was burning down. When the flames of fire would rise up, the people who were burning in it would also rise up and it would seem that they would go out now, but when the flames were suppressed, those people would also go down. There were naked men and women in this oven. I also asked on this occasion what is it? But this time too the answer was the same, let's go ahead now, let's go ahead. Now we were on a canal of blood. A man was standing a person received an old man was sitting, inside the canal and in the middle of it(Yazid ibn Harun and Wahab ibn Jarir have quoted the words of the bank of the river " Shat al-Nahar " instead of "Waste Nahar " by Jarir ibn Hazem)There was a man. In front of which was placed a stone. When the man of the canal wanted to get out, the man with the stone would hit him in the face with such force that he would go to his first place. He would have gone to the canal in his original place. I asked what was going on? He replied, "Let's go further." So we went further and came to a lush garden. There was a big tree in which the father old man was sitting, infather buying at the root of the tree and some children were also sitting with him. Near the tree, a man was lighting a fire in front of him. My two companions took me to the tree. In this way they took me to a house which I have never seen more beautiful and blessed. In this house old, young, women and children (all kinds of people)Were My companions took me out of this house and then climbed another tree and took me to another house which was very beautiful and beautiful. There were many old and young in it too. I told my colleagues that you guys made me feel good all night long. Would you please tell me the details of what I saw? He said, "Yes, the man you saw was tearing his jaw with an iron ax. He was a liar who used to tell lies." Other people would hear those lies from him. Thus a lie was spread far and wide. This is the torment that will befall him till the Day of Resurrection. The man you saw with his head being crushed was a man who had been given the knowledge of the Qur'an by Allah but he would lie down at night and do not act on it during the day. This torment will continue on him till the Day of Resurrection and those whom you saw in the oven were adulterers. And the one you saw in the canal He was a usurer and the elders who were sitting at the root of the tree were Abraham (peace be upon him) and the children around him were the immature offspring of the people. Entered Paradise was the house of ordinary believers and this house in which you are now standing is the house of martyrs and I am Gabriel and they are Michael with me. Well, now raise your head. When I raise my head, I see that there is something like a cloud over me. My colleagues said that this is your house. I said, "Let me go to your house." He said that there is still your age which you have not fulfilled. If you had fulfilled it, you would have come to your house. I was the house of the common believers in the paradise you first entered and this house in which you are now standing in the house of the martyrs and I am Gabriel and they are Michael with me. Well, now raise your head. When I raise my head, I see that there is something like a cloud over me. My colleagues said that this is your house. I said, "Let me go to your house." He said that there is still your age which you have not fulfilled. If you had fulfilled it, you would have come to your house. In the same way, whenever he wanted to go out, a person standing on the shore would throw a stone at his face and he would return to where he was. I (the angels who were with my companions) asked what it was, to which they replied that the man whom you saw in the canal was a usurer. [Sahih Al-Bukhari / Kitab Al-Abu'u / Hadith: 2085]

Hajjaj ibn Manhal narrated to us, Shu'bah narrated to him, said that I was informed by Aun ibn Abi Hajifah, said that I saw my fatherbuying a beggar (slave) . When I asked him about it, he said that the Prophet (peace and blessings of Allah be upon him) forbade the price of blood, the price of a dog, and the (illegal) earnings of a slave. And he cursed the tattooists and the tattooists, the usurers and the givers, and cursed the photographer. [Sahih Al-Bukhari / Kitab Al-Bayu'i / Hadith: 2238]

And Allah says (interpretation of the meaning): “ Those who slander chaste and free people, then do not bring four witnesses, then whip them with the same whip and never accept their testimony again. There are people among them who repent after that and do good deeds. Indeed, Allah is Forgiving and Merciful. He further said in this surah: " Surely those who accuse chaste and free and forgetful and honest women will be cursed in this world and in the hereafter and they will have a great punishment besides being cursed." He said in this surah: And those who accuse their wives and they have no witnesses except themselves [Sahih Al-Bukhari / Book of Warriors / Hadith: Q6857]

It is narrated on the authority of Jabir (may Allah be pleased with him) that the Prophet (peace and blessings of Allah be upon him) cursed the usurer and the feeder and the writer and the witnesses of usury and said: They are all equal. [Sahih Muslim / Kitab al-Musaqa / Hadith: 4093]
These are all the blessed hadiths in which the Holy Prophet has spoken about usury. We try to understand what he has said by studying them in-depth Muslims These include two hadiths of Sahih Muslims Raba,.
In all these hadeeths, the word is used in the Arabic text
Apart from this, the Holy Prophet (PBUH) did not utter another word for usury in these hadiths.
Some hadeeths have been translated into Urdu Rabakl al-Raba wamuqala (usury taker and giver) which is not correct, it means usurer and feeder. Yes, Get it out of your mind. Yes, it is said that curse on usurer and feeder. Now let us come back to the Holy Qur'an. Holy Qur'an took a soft line about the debtor. Now look at the meaning of the one who pays interest in all the hadeeths above which the scholars are taking the debtor (c). That the Holy Prophet has also cursed the debtor. The Qur'an has not only condemned him but also said that we have forbidden usury. Now you also do not go to collect usury again. So why did Bukhari and Muslims accept them, because the principle of the hadith is that the hadith which will clash with the Qur'an will not be accessed ted? And it is not that the hadiths are weak. No, it is not. So where is the problem? If you look carefully, there is a problem in determining the person to be fed because there is no ambiguity about the eater. And there is also a difference of opinion among the scholars of both groups. If you look at the hadiths, the hadith of Sahih Muslim is telling the whole picture about usury because the Qur'an had given us principles and now the hadith is explaining it. Let's look at the hadith again.
It is narrated on the authority of Jabir (may Allah be pleased with him) that the Prophet (peace and blessings of Allah be upon him) cursed the usurer and the feeder and the writer and the witnesses of usury and said: They are all equal.
This hadith is solving this problem and will determine who is the feeder. The Qur'an of the time is talking and even today usury has become a business. What is Mahajan Sood? A rich man can be called a moneylender, he does business of interest. He gives money to people and then receives installments from them. Men are needed by the man who has different responsibilities for which he gets paid. Even today, if there is an organization or big business, different people are performing different duties in it. There is a man who writes the paperwork and there is a man or some people who look for customers and entice them to provide loans in easy installments. When one takes a loan for a need.
Then the same people again receive the
installment from this person and give it to the owner of the locker. There will
be people, his business will spread so much and successful interest stands If someone(user)
has weak people, his business will fail. That is, the whole business depends on
these hired people. If these people are not there, the usurper will flop
in six months of the year no matter how rich he is. For the signing of this
agreement also he has kept witnesses for the convenience of the customer so
that there is no delay in the deal. They also belong to him on salary etc. Like
the staff of the bank now a day. Now add up, every aspect will be clear,
everything will be clear and everyone will be determined.
The Prophet (peace and blessings of Allah be upon him) saw this business
and commented on it, saying, the usurer and feeder (the people of him
who takes recovery from client gives it to the usurer), the one who writes the
contract and the two witnesses. The whole staff is all equal. The Qur'an did
not find the debtor guilty. Now all these hadeeths fit perfectly in the frame
given by the Qur'an. It does not collide at all.
